Website Design Agreement

Summary

We will always do our best to fulfil your needs and meet your expectations and to ensure that we are all on the same page, it’s important we have things written down so we can know what to expect from each other. This isn’t a complicated thing full of legal jargon and we aren’t trying to trick you into anything.


You are enlisting Kickass Marketing to design a website as detailed in our quote and project outline. There are a few more details that we need to cover to avoid any disappointment…


Written Content

Unless otherwise agreed upon, your website design includes professional copywriting. There may be specific information we will request from you throughout the design process. We will give you as much notice as possible, so you have time to collate the information. Delays in providing requested information may delay your project.


Logos, Graphics, and Images

We will require high quality files for your logo in all layouts as .PNG and .JPG files. You will also need to provide a style guide detailing fonts and colours if available. If your logo was not professionally designed, we may recommend contacting a graphic designer to redesign your logo so it is suitable for online use. We can make a recommendation if you need one.


High resolution digital photographs are required to make your site appealing and personalised. If you don’t already have images taken by a professional photographer, we highly recommend enlisting the services of one as this can really ensure a quality looking website. If you need recommendations for a local photographer, we will be happy to put you in touch with one wherever possible. If you choose to enlist your own photographer, we can provide them suggested images to capture that will work best with the website.


You will be sent a google drive link where you can upload any images and files you are providing for the website.

All images you provide to us must have permission from any original owners – we take no responsibility for copyright infringement on images you provide.


We may also use stock images where required from a variety of sources.


Delays in providing any of the mentioned files may result in a project delay.

 

Search Engine Optimisation (SEO)

We will endeavour to use your keywords and phrases throughout your website (both on and off page) where it makes sense to do so. While you may see some results from our basic included SEO, we do not make any guarantees of search engine rankings.


Advanced SEO is a big, expensive undertaking and will require the services of a dedicated SEO specialist. If you intend to explore this, we recommend doing some organic SEO activities for several months and collecting data before engaging an expert to help you with that.


If you would like to add on organic SEO activities to your package, please let us know.


Mobile Responsiveness

Our websites are tested on desktop, tablet and mobile however it is impossible to design a website that will display perfectly on every single device.  If you have a specific device you’d like the site tested against, please let us know.


Scope of project

Our project outline and quote will detail the work included in the scope of work. We know that sometimes plans evolve and you may come up with additional ideas that you’d like included in your website. Some of those may not make any difference to the amount of work involved and other will make a difference. If the scope of the project changes, we will advise you as soon as possible of any associated costs with such changes.


Project Duration

We allow 6 weeks from the date of deposit for completion of your website as standard. If your website design is more complex and requires longer, we will advise that at the time of our initial quote and project outline. The duration of the project may be quicker than 6 weeks if you are able to provide all the images, graphics, logos, and information requested and complete reviews of the website quickly.


If you are unable to provide requested files and information in a timely manner then this will delay the launch date of your website.


As much as we would love to be able to dedicate ourselves only to you, we do have other client projects to start and complete. If your project is delayed beyond the 6 weeks allowed, your project may be parked until other projects are completed ahead of yours. If the delays are more than 2 months from the original deadline, you may incur additional project reignite fees.


Failure to respond to communications within 21 days will result in the project being parked.


Reviews and Changes

You will have 3 opportunities to review your website design:


  1. Initially, we will send you a link to review a single page so you can see the overall look and feel that we are going with and provide feedback on it. It’s important to review at this stage as it will guide us for the remainder of the pages and ensure that we keep a consistent look across the website. Failure to notify us of anything at this point that then results in changes required across multiple pages may incur additional fees.
  2. Once we have made any changes agreed upon and completed the remaining pages of your website, you’ll be asked to review it in full. This is your opportunity to let us know anything you are not happy with, would like changed or pick up any mistakes we may have made (we are only human). 
  3. We will action any agreed upon changes from your second review and send to you for one final review before launching.


On larger or more complex projects, we may add in additional review stages to limit the amount of material you need to review and limit the volume of changes required.


If preferred, we are happy to do a website walkthrough via video call at the time of the second review.


Your feedback at each stage must be provided within 10 days. If we haven’t received your feedback within that time, we will assume you are happy with the design provided and continue to the next stage of the project.

Any bugs in the design detected within 1 month of launch date will be fixed free of charge. After that, any changes required will incur fees.


Please note that there are often reasons behind the way we design certain parts of your website. If you request a change that goes against these reasons, we may challenge you on the changes and explain why your changes may not be the best idea. It’s important to us that you love your website but it’s also important to remember that your website is designed for your target audience and not you!


After the launch of your website, you are free to make whatever changes you like to your website. Any help you require from us to fix up anything you may have done on your website will incur fees to do so.


Website access

Once your website is launched, you may request logins to the back end of your website. We are happy to provide these to you. We also provide a free short course on how to make simple changes to your website. If you require further training beyond this, we are happy to offer you one to one training as an additional service.

 

Payment Schedule

You understand how important cashflow is to a small business so your prompt payment of invoices is very much appreciated.


All website design projects require a 50% non-refundable deposit with final payment required once final approval has been received or 6 weeks after deposit date, whichever comes first.


On larger or more complex projects, we may add in additional payments but you will be advised of this at the time of quoting.


All payment options are detailed on your invoice. Credit card payments will incur fees.


Termination of services

You may terminate our service at any time with written notice. This does not relieve you of any payment obligations and you will be required to pay for any work that has been completed up until the termination notice has been received.


Copyright

Copyright of all work remains the property of Kickass Marketing until payment has been received in full at which point ownership of all materials become your property.
 
 

Displaying our work

We love to show off our website designs so unless we have a confidentiality agreement, we reserve the right to display any aspect of our work. This can often benefit you as we will always link to your website when showing off our designs. This may include social media, our website, magazine articles or books.


Getting the most out of your website

After your website is launched, there are several things you can do to help improve your google rankings and keep your website relevant for your target audience.



We will give you a guide at the time of launch outlining the things you can do to get the most out of your website.

We always do our best to provide work of the highest standard and do everything in good faith. We are only human and cannot guarantee that our work will be free of all errors. We won’t be liable to you or any third party for damages, including loss of profits, lost savings, or any other incidentals or special damages.
